Terms of Service

1. Acceptance of Terms

VitreOS (the "Service"), including the website at vitreos.org and the VitreOS iOS and Android apps, is provided by HeliOS Med LLC ("we", "us"). By accessing or using the Service, you agree to these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not use the Service. Your use of the Service is also subject to our Privacy Policy and our End User License Agreement. You must be at least 18 years old.

2. Medical disclaimer

VitreOS is a training logbook. It is not a medical device and does not provide medical advice or clinical decision support. Do not use it to diagnose or treat any patient or to make clinical decisions. Statistics, benchmarks and reports in the Service are for training tracking only and may not meet any program, certification or accreditation requirement.

3. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account. You agree not to:

  • Enter protected health information (PHI). VitreOS is not designed to store PHI, is not offered as a HIPAA business associate service, and does not enter into business associate agreements. Do not enter or import patient names, medical record numbers, dates of birth, contact details or any other information that identifies a patient, in any field. Enter only de-identified case data; the patient code field is for a de-identified code of your choosing. You are responsible for de-identifying case data and for complying with your institution's policies and applicable law. In-app warnings about values that look like identifiers are a convenience and will not catch every identifier.
  • Abuse leaderboards or other community features, for example by submitting false or automated scores, using offensive or misleading names, impersonating someone else, or interfering with other users' scores.
  • Share your account, or access another person's account or data without permission.
  • Probe, scan or test the security of the Service, overload it, or use bots or scrapers on it.
  • Copy, reverse engineer or resell the Service, or use it to build a competing product.
  • Upload malicious code, or use the Service to harass others or break the law.

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times, and keep your sign-in details confidential. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You can ask us to delete your account at any time (see Delete your account).

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of HeliOS Med LLC and its licensors. You keep ownership of the case information you enter and give us the right to host and process it to provide the Service.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach the Terms. You may stop using the Service at any time.

7. Disclaimer and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW. In no event shall HeliOS Med LLC, nor its members, managers, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
